Discrepancy in the Official Records

This session will examine how the courts and the Interior Board of Land Appeals (IBLA) have resolved various types of discrepancies in the official survey record. Principles will be presented for resolving the most common discrepancies including:

  • Inconsistencies on the face of the Plat;
  • Plat bearing and distance does not agree with the field notes;
  • Field Notes are ambiguous;
  • Field Tablets vs. Official Field Notes;
  • Areas are not based on the distances shown of the plat; and
  • Haitus and overlap situations.
Upon completion of the course the surveyor will have a basic knowledge of the pertinent case law, know how to apply the principles for resolving records discrepancies and understand how other factors might influence decisions.

Note: The Wednesday workshop is a 2-cedit hour CFedS Continuing Education Course. CFedS participants, who pass a post quiz, can earn 2 CFedS CE credits after the seminar is presented.

County Remonumentation Status in MN

Attention all Surveyors, your help is needed! How many PLSS corners are in your county? How many PLSS corners are certified in your county? MACS has taken the first step toward remonumenting all the PLSS corners in the state; all the corners, and all the certified corners, have been counted. The next step is to find a way to remonument the remaining corners. MACS has formed a committee to find a solution. Join me for an open discussion of options and ideas on this subject.

A1. Ethics in Surveying

Ethics is not unique to our land surveying profession – it is an integral part of our daily lives – personal and public. A general definition of ethics is “the study of human conduct with an emphasis on the determination of what is right or wrong”. Our land surveying profession is not an exact science and affords us plenty of opportunities to make ethical decisions. Overall, we have relatively few “absolutes” and many “possibilities” involved in our land surveying decisions. The National Society of Professional Surveyors (NSPS) provides us with a “SURVEYOR’S CREED AND CANONS”. Our discussion will examine the NSPS Canons, consider a few situations that require an ethical decision and solicit opinions as to the “professional” approach that should be taken.

A2. The Rectangular Land Surveys in the Minnesota Territory

Before the Minnesota Territory existed and for most of its territorial period, until 1857, surveying operations that imposed a rectangular grid on its land surface – creating parcels of land with well-defined boundaries and a unique location – were administered by the office of Surveyor General of Wisconsin and Iowa. From 1847 until 1853 deputy surveyors, working under instructions issued in 1846, established and subdivided townships in the area between the St. Croix and Mississippi rivers, part of the area ceded by the Chippewa bands in 1837. In 1853 the first surveys were carried out west of the Mississippi River, in the area ceded by the Sioux bands in 1851, by deputies working under instructions contained in the Oregon Manual issued in 1851. During the next four years survey lines spread throughout the ceded areas, and those that were subsequently ceded by Chippewa bands in 1854 and 1855, through the work of deputies working under instructions contained in the Oregon Manual issued in 1851, instructions that were revised in 1855 as the Manual of Surveying Instructions. In 1857 Congress established the office of Surveyor General of Minnesota necessitating that the Surveyor General of Wisconsin and Iowa transfer some of the records of the surveys already made in the Minnesota Territory from Dubuque to St. Paul. The first Surveyor General of Minnesota, Charles L. Emerson, was charged with closing the office of Surveyor General of the Northwest – an office established in 1796 – then in Detroit, and opening an office in St. Paul that remained in operation until 1908.

A4. Vendor Session - Infrawork's New Point Cloud Feature Extraction Tools

Let’s dive into the complete process of creating an .RCP file while in ReCap Pro software and importing the Point Cloud into Autodesk's InfraWorks software, and see the step-by-step process of creating both a usable InfraWorks surface but also extracting features from your Point Cloud using both the new Point Cloud terrain and Point Cloud modeling tools within InfraWorks. The Point Cloud modeling tool is like your description keys in AutoCAD Civil 3D software, but instead of 2D blocks you'll get 3D features like power poles and trees automatically inserted into your model. We'll take you step-by-step through the process to help save you time.

B1. The Center 1/4

Will we ever really come to an agreement as to the proper location of the Center 1/4 of a government section of land? Many years after approval of a government survey a particular Section 9 was subdivided by a private surveyor and a metal monument, representing the Center 1/4, was set, platted and officially recorded in the local county recorder’s office. For the next few decades every surveyor who worked in Section 9 accepted the private surveyor’s metal monument. Then, along came a “more expert” measurer, who set another “Center 1/4" a short distance away. SOUND FAMILIAR? Come prepared to chime in on the fun.

B3. New Datums: Replacing NAVD 88 and NAD 83

NAVD 88 and NAD 83, which are still the official vertical and horizontal datums of the National Spatial Reference System (NSRS), have been identified as having shortcomings that are best addressed through defining new horizontal and vertical datums. The new reference frames (geopotential and geometric) will rely primarily Global Navigation Satellite Systems (GNSS) such as the Global Positioning System (GPS) as well as an updated and time-tracked geoid model. This paradigm will be easier and more cost-effective to maintain. Learn how the new datums may affect your work.

C1. MN DOT ROW Acquisition Process

This course will provide a basic overview of the MnDOT acquisition process from concept to condemnation. This session will start with the engineering and planning phases and then continue through the preparation of the title opinions, field titles, plats, legal descriptions, and appraisals. In rounding out the course, we will touch on the negotiation phase before finishing with MnDOT’s condemnation process.

C3. Beltrami County Remonumentation Efforts

Beltrami County is actively involved in the remonumentation of its Public Land Survey System corners.  This presentation will review the various tasks involved with the project, the archival process for all information collected and generated, and the implementation of data into the County’s parcel fabric and many base layers which are eventually reflected in their interactive web mapping applications serving the public.

D2. 24/7 - The Stearns County Surveyors Office is Always Open!

Stearns County is using GIS and SharePoint to provide 24/7 Customer Service to Land Surveying and Civil Engineering professionals. In the past our customers and business partners had to call, email, or stop in the office to get PLS information. Even when some of our products became available online it was not necessarily complete or in a single location. That is no longer the case. Starting this spring, we have a one stop shop for all things Survey. Land Survey and Civil Engineering professionals can now access current and historical documents from a map or tabular based search. The application pulls data and images from many SharePoint locations, including custom lists and document libraries.

D3. NGS Tools to Support New Datums

NGS will publish updated information for the records in its custody to implement the new datums in 2022. However most users will need to update or convert their own records. NGS has created several tools to aid in the process. This session will focus on NADCON/NCAT, VERTCON, DSWorld, and OPUS tools.

E1. Court Cases Every Surveyor Should Know

"Who cares??? Surveyors frequently conduct their lives and entire history without setting foot in a courtroom. The case law component of our system of laws, rules, regulations, ordinances and other guides to live and work by, can often be difficult to understand and to apply to our surveying practice. This talk will focus on several state and Federal cases, some old and some current, and their application to the current environment. Historic court cases give us a ‘foundation’ for the interpretation of land law issues today, and the steady process of court actions continues. Who knows what will happen tomorrow? Many of the issues we thought would happen in the digital age have still not been tested in the courts – data in computers (data collectors) rather than in field books, corruption of the original drawing by digital modification rather than an eraser, and the judges often have no clue about boundary law, and certainly no time to learn about it. Our dream of a ‘real estate court’ remains just that. Bring your questions!! "

E4. User Defined Properties in Civil 3D

Manually creating labels for Storm and Sanitary structures from surveyor notes is never a fun task in Civil 3D. The risk of human error is always there, whether it is misreading the surveyors notes or even transposing the numbers during the data entry. With User Defined Properties the surveyor will enter the direction and measure downs for each structures invert into the data collector and Civil 3D will generate a label automatically, eliminating one chance for human error. This class will walk you through the process of setting up User Defined Properties, creating a point file format with more than 5 columns (PNEZD) and then a label style so that a structure label will automatically generate the Rim Elevation, Invert Elevation and Invert Direction. A few extra seconds in the field can save hours in the office.

H1. Statewide Torrens

"Session Description: Initiative to Modernize Minnesota Land Records Technology has transformed our personal lives and our expectations of government and for-profit businesses. With “modernization” in mind, the Minnesota State Bar Association Legislative Committee conducted eight stakeholder “Reimagine Land Records: Listening Sessions” in October 2017 across the state. This presentation will include a summary of the issues and ideas discussed, and an opportunity for the attendees to react to the themes and next steps.

H2. The Skunk River is Death on a White Man

Sometime in the fall of 1998, I ran across a letter offered for sale on eBay. The letter was from E. S. Haines, the Surveyor General at Cincinnati, Ohio, informing A. G. Ellis, the Surveyor General at Dubuque, Iowa, that a shipment of paper was on its way aboard the Steamboat Rochester. The letter was dated August 29, 1839 and appeared to be authentic, so I purchased it. At the time I assumed it was a one-of-a-kind opportunity but it turns out that such letters appear with considerable regularity and over the intervening years I have amassed a collection numbering close to 100 such letters. Some of the letters contain little tidbits about day-to day events in the lives of the GLO deputy surveyors, items typically missing from field notes and first person accounts. Some of the letters were written by men who later became noteworthy in fields other than surveying. Some are amusing, some are mundane, some are dramatic but they all have a story to tell and I have put together a presentation that attempts to tell that story.

H3. Two Metro Area Unique and Interesting Projects

MAJOR LEAGUE STADIUM AND SUPERBLOCK

Minnesota United FC, a North American Soccer League team, is constructing a 20,000 seat major league soccer stadium at I-94 and Snelling Avenue in St. Paul, as part of a planned and coordinated redevelopment of the entire 34.5 acre superblock. The goal is to create a new urban village surrounding the stadium that includes retail, office, residential and public open spaces. Loucks is providing land surveying, site design, and civil engineering services for the project. Mr. McGinley will present on the key surveying issues that arose during the stadium development such as errors in historic title documents and the construction of a stadium which sits three-fourths on adjoining un-platted land and one-fourth on a new plat of the superblock. He will also give some insights into the complicated process of coordinating and overseeing the demolition of parts of the Midway Shopping Center. He will touch on the documentation of excavation removal, offsite transport and/or replacement on-site. You will also get a preview of the phenomenal final stadium and the redevelopment concepts for the surrounding 25 acres.

A-MILL ARTIST LOFTS

Pillsbury A-Mill is one of Minnesota’s National Historic Landmarks. In 2013, the 400,000-square-foot building began its transformation into 251 affordable housing units for artists. By preserving historic elements, A-Mill artist lofts pays tribute to the former site of the “World’s Largest Flour Mill” and its significance in the region’s history. Loucks provided land surveying, civil engineering, and 3D laser scanning services for the project. Mr. McGinley will provide some background on the procedures and results of Loucks’ digital scanning of the entire 7 story building - inside and out and the 3D model of the building created. You will also see the digital scans of sections the original 1800’s headrace and tailrace tunnels that conveyed water from the Mississippi under St. Anthony Main, through the A-Mill and back to the river. You will also see images of the final result as the historic hydro system was repurposed as a hydroelectric generating plant in the sub-basement of the A-Mill now providing over 80 per cent of the electrical power for the building.

I1. Lots, Tracts, Parcels, Occupation, Ownership and Zoning

Lots, Tracts, Tax Parcels, Torrens Parcels, Zoning and Development Districts, ownership, occupation, and more are designations and conditions all apply to the real property we work with daily. While all of these can be applied to the same property, they each exist in their own realm, each addressing their own purpose. These designations need neither be contiguous, nor directly related to each other or the subject property. This creates situations that can be challenging to a professional, but downright incomprehensible to the lay person. Understanding the relationships and distinctions between these designations can be critical to providing effective professional service to landowners trying to navigate a dizzying array of unfamiliar, authorities, regulations, and terms, while trying to exercise their rights of ownership. This presentation will attempt to outline and clarify the distinctions and relationships between these designations using real world case studies from the presenter’s experience in the City of St Paul. Particular attention will be paid to identifying the authoritative sources, and appropriate application of these concepts within the context of land development in a local government regulated environment.

I2. Lewis & Clark Surveying and Mapping the Northwest Passage

Lewis and Clark surveyed and mapped the Missouri River, across the Continental divide and down the Columbia River to the Pacific Ocean. On the return trip they split up the party and surveyed the Yellowstone River and Maria Rivers in Montana. Clark prepared the first accurate map of the Northern part of the Louisiana Territory. What were the instruments used, field notes and maps produced by these early surveyors?
